"...The authority of an agent must be distinguished from his power. A transaction entered into by A within the scope of his actual authority from P will, of course, bind P. But P will also be bound if A acts within his apparent authority. In such a case, though A does not have the right to enter into the transaction on behalf of P, the law invests him the power to commit his principal to the transaction."
