According to the Ontario Superior Court of Justice, certain assets and bank accounts on Canadian soil cannot be seized by the families of Flight PS752 victims because the federal government considers these assets the property of Iran under international law. Five people died three years ago when Iran's Islamic Revolutionary Guard Corps shot down a commercial plane, killing 176 people, including 85 Canadians and permanent residents. A provincial court awarded $107 million to their families, plus interest. Because Iran didn't defend itself, it got a default judgment. As a compensation, lawyers representing the families have been trying to seize Iranian assets in Canada. Canada expelled Iranian diplomats a decade ago, so Iran's diplomatic immunity ended. Iranian families wanted to take over three properties in Ottawa and withdraw money from banks maintained by Iran at the Royal Bank of Canada and Scotiabank. Following a court proceeding in March, the Canadian government issued a certificate claiming that international law does not permit the court to order the seizure of Iranian assets.It was stated in the certificate that Iran continues to "enjoy the privileges and immunities." A judge with the Ontario Superior Court has dismissed the motions filed by the families on Tuesday, siding with the federal government. In an announcement issued to CBC News on Thursday, Global Affairs Canada stated Iran carries full responsibility for the destruction of the plane and that they are seeking arbitration with Iran. According to a statement released by the department to CBC News on Thursday, Canadians and other countries may take the case to the International Court of Justice if the matter cannot be resolved by the end of June.
