Acting in accordance with the ordinary legislative procedure, the European Parliament and the Council adopt a directive harmonising the conditions that must be met by domestic alarm and security systems. One of the conditions requires such systems to delete automatically all video footage within 24 hours of its having been recorded. Sounding Off (SO) is a manufacturer of alarm and security systems. It belongs to a consortium of other manufacturers who have been working on a new product called Black Alert. Black Alert will distribute video footage from alarm and security systems to each mobile device belonging to the customer.The consortium intends to launch Black Alert very soon in a carefully planned publicity campaign in which it has invested a considerable amount of money.The CEO of SO is worried about the implications of the new directive for Black Alert. She asks for your advice on whether anything can be done to challenge the lawfulness of the directive.

Advise the CEO as to the chances of challenging the directive successfully in:

(a) the Court of Justice, and

(b) a national court.
