Adam is a 10 year old boy in 3rd grade with down syndrome. His parents decided to sue the school because they did not offer FAPE- because they did not offer extended school year in the least restrictive environment and because the district pre-determined his services. He spent 2nd grade in general education class and receiving alternative curriculum. When the parents attended the annual IEP, the school decided for 3rd grade that Adam would be in an SDC classroom with moderate/severe students. The parents believed Adam should be in a mild/moderate class because they teach a general education curriculum and Adam because he fit in with his peers.
