After many months and several design changes, the dress was approximately 60% finished. Addie and Tony had many differences of opinions and they agreed the marriage would not work and went their separate ways. Addie, with all the stress and emotions running high, forgot to inform Carlye Crane and the completed wedding dress was delivered to Addie. Addie refuses to pay. She no longer needs the dress, hates the dress and states she is not liable because the contract was oral. Is the oral contract enforceable? Explain. d. Addie puts a deposit of $5,000 for the wedding venue at The Schmidt House for her and Tony's wedding on 10/15. The contract states that the deposit is non-refundable for any reason. Addie loves the Schmidt House and does not really read the contract. She sends the Schmidt House a letter stating she would like her deposit returned given the fact that many of her guests cannot attend because of the COVID restrictions and is claiming that this a force majeure. Along with the fact that Tony and her are no longer getting married. Discuss her force majeure claim.
