b) Shiloah Bank received a cheque drawn on the current account of Mr. David Patel for $800,000. Mr Patel's account was in credit in the amount $1,000,000. The bank clerk who processed the transaction, tried erroneously to debit the account of Mr. Dave Pratell whose current account was in credit in the amount of $100,000. The cheque was dishonoured with the notation "Returned for Insufficient Funds". Mr. David Patel was humiliated and suffered financial losses in his textile export business when his cheque was rejected; and therefore sued the bank for damages.Advise Shiloah Bank on its legal position.(10 marks)
