Advise Fury to what extent, if at all, she is legally bound by the above agreements.
Fury, a film producer, is due to start filming his latest film on 1 January. Filming is due to be completed by 31 May. The film is to be released on 1 December.
It is agreed that Fleck, a well-known actor, will be paid a lump sum fee of £90,000 once the film is released. On 1 April, Fleck tells Fury that he has received a lucrative offer from a rival film company to start filming immediately and he explains that because of his dire financial situation he is giving their offer serious consideration. The loss of Fleck would mean that the film would have to be abandoned. Fury agrees to pay Fleck £150,000. On hearing this, Fleck loses 25 kilos and learns to play the piano to make his character more authentic and believable, despite the fact that this is not required under his contract with Fury.
Zazie, a film editor, agrees with Fury to edit the film by 31 October for £50,000. By the beginning of October, Fury becomes concerned that Zazie is unlikely to complete the work by the deadline. Fury is very worried that any delay might put her in breach of a contract that she has with the film distribution company. Fury agrees to pay Zazie a further £25,000. This sum enables Zazie to pay her staff overtime to help with the work. Zazie completes the work on 31 October, and the film is released as planned on 1 December.
Fury also employs Larisa to make and edit the movie trailer. It was agreed that the fee would be £20,000 and that the work would take four weeks. Two weeks into the job, Fury asked Larisa if she would also create the trailer music as Fury had suffered creative differences with the music production company and terminated their contract. After Larisa completed the work, Fury said that she was so pleased with the overall job Larisa had done, including the work creating the trailer music that she was going to pay her a £10,000 bonus.
The film is a huge success at the box office. Fury refuses to pay Zazie the extra £25,000 and also says that she is not legally obliged to pay the £10,000 bonus to Larisa. On 23 December, Fury gives Fleck a cheque for £90,000. Fleck is angry and complains that Fury agreed to a fee of £150,000.
