(a)Explain the doctrine of 'eminent domain'.

(8 marks)

(b)Priya, has had an idea of a novel, for a while. She has written down the plot of the story in her diary but hasn't started writing the novel yet. In the meantime, she has a meeting with her publisher, who has published her last few books and shows the plot to the publisher. The publisher thinks it's a great idea and encourages Priya to start writing soon, but Priya says first of all she wants a break from writing and go travelling to remote parts of the world, untouched by tourism.

12 months later, Priya returns to Christchurch and finds that a book, remarkably similar to her plot that she had discussed with her publisher, is out in the book stores. The author of the book is a cousin of the publisher and is being managed by the same publisher.

Required:

Advise Priya is she has cause of action against the author and/or publisher.
