Allen hired Ben to demolish his rescue dog's current doghouse and then design and construct a new doghouse on-site so it could match the decor

Allen hired Ben to demolish his rescue dog's current doghouse and then design and construct a new doghouse on-site so it could match the decor of his home. It was hard for Allen to pick just one design, and after several conversations, the two agreed, in writing, as follows:

1. Ben will demolish the current doghouse, remove its foundations, and clear the building site at Allen's home.

2. Ben will custom design and construct a new doghouse on-site with a poured concrete foundation and heated concrete subfloor, to include a red-clay tiled roof, terra cotta flooring, a skylight that admits natural light, and a "diamond glass" front wall.

3. Allen will pay $100,000; $80,000 upon signing of this agreement, and the remainder upon completion of the doghouse.

4. Ben will complete construction of the doghouse no later than 5:00 p.m. EST on November 23, 2020.

Allen and Ben met at Ben's office to sign the agreement. Before signing it, Ben agreed that when he completed construction of the doghouse to Allen's home, he would also give Allen a coupon for a year's supply of premium dog food. Before signing, Allen exclaimed, "wow, that coupon sealed the deal!"

When Ben began to install the "diamond glass" front wall, he noticed that the "diamond glass" was not as scratch-resistant as he hoped, and from his experience, plexiglass would be a better choice.

Ben informed Allen of the problem and recommended the plexiglass option, but Allen refused Ben's suggestion, saying his rescue deserves nothing but the best for her $100,000 home. Because of the issues with the "diamond glass" and Allen's refusing to use plexiglass, Ben had to purchase a better grade of "diamond glass" from India. Ben informed Allen that because he needed to replace the glass with this better grade from India, he would need an additional week to finish the doghouse.

Allen insisted that Ben had to finish the doghouse by the date in the contract because "that was our agreement. Plus, I have to have the doghouse in time for my annual Thanksgiving dog show viewing party." Ben said, "I'll have to replace the glass and expedite the shipping to finish the job by the 23rd, so you will have to pay an additional $,1000 if you want the job done on the 23rd!"

Allen agreed to pay the extra $1,000 because he really wanted the job done on time. Ben was able to finish the job by the contract's deadline.

When Ben completed construction and then went to collect payment from Allen, Allen refused to pay the extra $1,000 and he also refused to pay the $20,000 balance due under the contract because Ben did not have the coupon for the year's supply of dog food.

1. Does Ben have an enforceable contract with Allen for the doghouse and the year's supply of premium dog food?

2. If so, does Allen owe Ben the extra $1,000?
