Alpha Omega Pet Services (AOPS) is a business which provides all manner of services for pets from birth through to death. They specialise primarily in dogs and cats. They breed and raise them, have a full veterinary clinic and boarding facilities, and even offer full funeral services. All of these services are performed in the one large facility based just outside of Adelaide's CBD. Melissa takes her prized cat to AOPS and requests a full clean and grooming. She signs the service contract and pays the $150 fee upfront before being told that she can collect her cat the same afternoon. To her horror, when Melissa returns to pick up her cat, she finds that AOPC has made a terrible mistake with the paperwork and mistakenly put down the cat before having it stuffed and preserved by the in-house taxidermist. AOPC offers Melissa her money back but Melissa is outraged and threatens legal action. AOPC refer Melissa to an exclusion clause in the service contract which reads: 'AOPC accepts no liability for any injury, loss or death incurred by any animals held in its care resulting from the negligence or otherwise of its employees'.
