Andrew and Sarah planned to get married on 15 October 2021. They had a dream to organise their wedding banquet in River Park Hotel. On 5 October 2020, they booked the Grand Hall at River Park Hotel for their wedding banquet. The wedding package fee was HK$50,000. Andrew paid a deposit of HK$5,000. Beatrice, the event manager of River Park Hotel, confirmed their reservation. In August 2021, the Government issued regulations in response to the COVID-19 pandemic. A ban on gatherings of more than 4 persons in a table was imposed. Beatrice explained this regulation to Andrew and Sarah. To play safe, Beatrice proposed that they could organise their wedding banquet in the garden instead. Andrew and Sarah accepted her proposal as long as they could organise their wedding banquet in River Park Hotel. Among three Wedding Gardens, Andrew and Sarah selected the Wedding Jubilee Garden by the poolside for their wedding banquet in River Park Hotel. On 30 September 2021, the Wedding Jubilee Garden by the poolside was destroyed by the typhoon. After the inspection of the Wedding Jubilee Garden by poolside, the hotel's engineer confirmed that the garden was not safe. It would take at least 14 days to repair. Beatrice told Andrew that the Wedding Jubilee Garden by the poolside would not be available for their wedding banquet because of safety concerns. Beatrice told Andrew that River Park Hotel could refund the deposit to Andrew. Andrew was not happy with Beatrice's explanation. He wished to sue River Park Hotel for breach of contract.
(a) Advise River Park Hotel. (18 marks)
(b) Andrew and Sarah placed the order of 100 chocolate giftsets with iChocolate shop. The giftsets would be given to the invited guests on their wedding day. They signed the contract which stated that the giftsets would be delivered on 14 October 2021. Andrew and Sarah told River Park Hotel that they would cancel the order and the deposit of HK$2,500 paid to iChocolate would be forfeited if none of venues were available for their wedding banquet on 15 October 2021. They will request River Park Hotel for compensation. Advise Andrew and Sarah on whether they can claim the damages from River Park Hotel in this case.
