QUESTION 1 :

Section 4(1) of the Industrial Relations Act 1967 states that: "No person shall interfere with, restrain, or coerce a workman or an employer in the exercise of his rights to form and assist in the formation of and join a trade union to participate in its lawful activities."

In light of the above provision, examine the extent to which a trade union and a workman may make a claim that an employer has violated a worker's rights in exercising his rights as a member and/or to participate in the activities of the trade union without restraint and without interference from the employer. QUESTION 2 :

Zahir comes to you for advice on the following problem: Recently, he had to resign from his employment because he was frustrated for having been transferred three times to various branches of the company within the last six months prior to his resignation. He further claims that, throughout that period, his employer did not give any justifications concerning the transfers. He was also repeatedly humiliated by his employer in the staff meetings.

Advise Zahir regarding his legal rights under employment law and any remedy he may have against the employer. (20 marks)
