(a) Ruby saw a vase in a shop and asked the seller whether it was Victorian. The seller replied that he thought it probably was Victorian. The seller further informed that the vase previously belonged to his grandfather which he had always said that the vase was Victorian but this fact was never verified and hence the seller was not sure. Ruby bought it and later discovered that it was only 10 years old. Advise Ruby whether there is a valid contract between Ruby and the seller.
(b) Georgia is 15 years old. Last week, she wanted to attend a birthday party for her friend, Audrey, the daughter of a glamorous Hollywood star. As she did not have a new pair of shoes for the function, she ordered an expensive pair of shoes from a famous shoe store. The shoes cost RM3,000 per pair. She wore the shoes for the function but has not yet paid the purchase price of the shoes. The shoe store owner wishes to sue Georgia for the purchase price and he seeks your advice.
i) Advise the shoe store owner whether he is able to sue Georgia for the price of the shoes.
ii ) Would your answer be different if Georgia is a successful teenage celebrity and she bought a branded diamond shoes costing RM8,000 and she now refuses to pay on grounds that she is not of age.
(c) Sarah lost her pet rabbit. She placed the posters around the neighborhood asking members of the public to help find her rabbit. Jacob, who lives nearby found the rabbit and returned it to Sarah. Sarah then promised to give Jacob a reward of RM2000 for having found the rabbit. To date, Sarah has not paid Jacob yet. Advise Jacob if he could pursue the reward from Sarah.
(d) Nana, Norman, and Natalie are siblings. One day, they agreed to form a syndicate for the purpose of making a weekly entry in a fashion contest in a local magazine. As Norman and Natalie do not know much about fashion, they gave Nana RM10 each week for her to fill in and send off the contest forms every week. However, she always fills the forms in her own name. After one month, one of the entries that Nana sent won an RM20,000 prize. Norman and Natalie are very happy about the news and wish to claim their shares. Nana now refuses to share the prize with them. Explain whether there is a binding contract between the three siblings.
