Mary visited Ever-beautiful Furnishing, a local furniture manufacturing facility where she was shown a Victorian style eight-seater dining table for $300,000.00, that she immediately fell in love with. She then explained to the manager that she would purchase the dining table and chairs but wanted the padding for the chairs to be changed to coloured stripes instead of the solid colour that they had. She also wanted a pattern placed in the centre of the dining table. The store manager informed Mary, that she would be called when the table and chairs were ready for her to pick up. Two weeks later, Mary was called and informed that the dining table and chairs were ready for collection. Mary informed the representative that she would collect on September 25. Unfortunately, Mary tested positive for the Covid 19 virus on the 25th September and she asked her husband Jack to collect the items. He forgot to do so. On September 30, Ever- beautiful Furnishing store along with all the furniture inside the warehouse were destroyed by a massive fire that occurred on the street. Mary is insisting that she should not pay for the items again as they were with the store and they are therefore responsible for all losses. The store manager is adamant that they are not responsible for any of the loss.
