1. Anthony R had lost a leg and needed a wheelchair. He approached Niagara Mobility in St Catherine's, ON and they referred him to RKG in Ottawa. A representative of RKG Ottawa came to his home and took measurements, which where then sent to RGK Wheelchairs in England for the chair to be made. When the chair was done, they sent it to Niagara Mobility, with the warranty, who in turn sold it to Anthony.

At first, he was satisfied with the chair, but things started to go wrong. Eventually the wheelchair collapsed and he fell into the street in front of a car and suffered serious injuries.

Anthony sued RKG Ottawa for breach of contract - will he win, why or why not?
