1. Apart from the approach to legislative history, what is the significance of the "Mortier" case? Would the preclusion fo local regulation of pesticides matter to local governments and environmental groups>? Does the continued local regulation of pesiticides matter to the agricultural industry? Do these issues matter to us all? If so, why doesn't the court address the merits of the dispute and underlying policy issues rather than simply debating the language and legislative history of the statute?
