A small business owner is excited to begin a new business venture in the upcoming weeks. However, the owner has encountered several business issues that have prompted them to reach to you for advice.
1. The business owner has located their business in a quaint location that is guaranteed to receive foot traffic. However, the facility does not offer the space needed to produce its goods. Luckily the business owner has outsourced the production of the goods to a family member. This arrangement has worked for the first few weeks of operations, but now the business owner wants to increase the output of goods. The business owner is wondering if they should put something in writing or develop a contract regarding the production agreement. Also, the business owner is wondering what specific elements are necessary to make an enforceable contract.
2. The business owner has also partnered with two siblings and wants to divide the ownership equally among them. Yet, the owner wants to protect them along with themselves from full liability in the event something goes wrong with the business. The business owner wants to know which business structure you would recommend satisfying these needs.
3. On the first day of operations, an unusual accident occurred wherein a bicyclist crashed into the Grand Opening sign, which was positioned on the sidewalk directly outside of the business.
