As it relates to body worn cameras, can an officer walk into a hospital as we often do, and record? There is an argument out there that says no, because of HIPAA laws. The fear is that the camera will pick up sensitive data that cannot be released; possibly a medical record laying out and opened, or a conversation between emergency room medical staff and a patient, etc. Therefore since it has the potential to pick up that medical related data, then the body worn camera cannot be operated in this environment.
What about police transparency? Especially in a situation like use of force? I have been in situations in the emergency room area of hospitals where I had to use varying levels of force to restrain someone. Now if I am not recording, am I trying to hide what really happened during the use of force from the general public? Again, what is the best route to go here.
