When a mistrial happens, there is no verdict. A mistrial with prejudice means charges can't be brought again(misconduct for the state) so it's permanently gone. A mistrial without prejudice means it can be retried. The thing they have in common is the defendant was never found guilty or not guilty.

Washington pleaded guilty to 3 capital murder charges just like Adam's case the attorney failed to call the witness but Washington was sentenced to death.
