As Opio was stepping out, he saw a poster advertising a herbal drink. The poster was informing members of the public that the herbal drink helps to boost the flow of blood especially to young adults. The drink was to be taken twice a day for two weeks. To show their commitment, the company that produced the drink (Herbal Uganda LTD) had deposited UgX 25,000,000 in Equity Bank, Uganda. The money would be given to anyone who used the drink and still had blood flow issues. Opio immediately bought the drink and began to use it. After one week, the company issued another notice on social media and outside the supermarket stating that new scientific evidence had come to light which showed that the drink is not effective. As such, customers were advised to stop using the drink. Opio did not see the advert. He is not on any social media platform and has not been to Bukoto Street in a while. He continued using the drink for another week but still has blood flow issues. He in fact has decided to go to Mulago Heart Institute for professional help. He now intends to sue the company. The company is alleging that it issued out the withdrawal notice and therefore going forward, there was no contract?
The issue is whether there was a valid contract between Opio and Herbal Uganda LTD? If so why or if not why?
