AS SUPRESSION DA WHAT IS THE PROFF THAT THIS WAS KNOWINGLY, INTELLIGENTLY AND VOLUNTARILY

On September 7th, 2011 at 0450 hours, we spoke with actor, Alex Smith, in regard to the above referenced matter. The interview in question took place in an interview room of the Homicide Office located at 1203 Western Avenue in the Southside section of the City of Kansas. At the start of the interview, we read Smith his rights from Kansas Bureau of Police Miranda Rights Warning Form. Smith stated he understood his rights, waived them, signed the form, and agreed to give a statement.

Smith stated the incident started with an argument between his sister Alex, and his sister's friend Katie. More specifically, Smith stated Katie's sister called his mother and told her that his sister, Alex was ingesting Klonopin pills. As a result, Smith's mother and sister argued This argument led to a telephone call (3 way) argument involving Alex, Alex boyfriend, Danny, and Katie's brother, Frank. At one point, Smith got on the phone and argus with Danny and Frank.

Sometime after this phone call, Smith looked out of a window from his house and saw cars pulling up and parking near his residence. Multiple people, including Katie and Frank, exited the cars, and approached the house. Smith, his father, and his sister, exited their home, and a fight started between his sister and Katie. Smith's father tried to break up the fight Frank approached with a bottle in his hand and told Smith's father to let the girls fight.

At this time, Smith state he entered his house, picked up a meat clever, and placed it in his back pocket. Smith's father entered the house and called the police. Smith went back outside and exchanged works with Frank. Smith stated Frank inched closer to him with the bottle and threw it at him. Smith stated the bottle missed hin abd shattered on the ground.

When Frank came closer to him with his fists, Smith took out the meat clever and struck Frank at least two time until the clever broke into pieces. Smith added his father may have bee holding Frank at the time he struck him with the clever. He also stated his father may have been fighting "the uncle" at the time. Smith added that after the meat clever broke into pieces, started to fight "the uncle" with his fists.

After the fight, the individuals involved got back into their cars and pulled away from the scene. As the cars were pulling away, Smith heard a voice yell out something to the effect of, "you stabbed me!" or "you stabbed my nephew you did have to do that!" Smith heard his father respond "you came to my house!" you started problems at my house!".

Smith stated he believed a total of six people arrived at his house at the time of the incident.

At the conclusion of the interview, Smith supplied a voluntary, digitally recorded statement.
