This assignment relates to the following Course Learning Requirements:

CLR 1 - Extract and gather information utilizing professional and ethically accepted interviewing techniques as defined by law

CLR 2 - Select the most appropriate technique in a variety of situations in order to extract information

CLR 3 - Apply Canadian Charter of Rights and Freedoms provisions and rules of case law references when making and using notes, gathering evidence and information from persons of various places in jeopardy to ensure the admissibility of those statements

CLR 4 - Apply basic communication skills (both verbal communication and non-verbal communication) in the area of listening and speaking while having the ability to recognize the significance of body language and environment in the interview process

CLR 5 - Record investigative notes in compliance with legal and ethical standards CLR 6 - Identify appropriate sources of information relative to investigate needs CLR 7 - Progress through the basic sequential steps of an investigation

CLR 8 - Construct and apply descriptive factors for identification of suspects and other persons

Objective of this Assignment:To demonstrate your ability to conduct a structured interview with a victim and/or witness.

Instructions:

For Assignment 3, you will set up a mock interview with Jim and Paul to extract any information that may be used in your investigation. Once you get the information about the suspected manager (Paul), then move your interview into an interrogation to extract the truth from Paul.

In this assignment you are to interview a friend or family member that will play both Jim and Paul. I will not accept an assignment without you interviewing a real person so that I can assess your use of body language and proxemics.

Remember to use open-ended questions during the interview and accusatory questions when interrogating. These stages need to be followed:

  • First Stage - Factual Analysis
  • Second Stage- Interview of possiblesubjects
  • Third Stage- Accusatory Interrogation

Make sure you go through the Reid's Technique steps when interrogating Paul so that he eventually confesses to the staged break-in and the theft of the money.

Using facts you collected from interviewing the innocent manager (Jim) will help you obtain a confession from the guilty party (Paul).

The video needs to be at least 5 minutes for both interviews. Make sure you set the physical environment properly for both the interview and interrogation. Prepare in advance the types of questions you will ask both managers.

These questions will need to be emailed to your instructor upon completion of the video.

There needs to be a clear identification of the use of the Reid Technique when talking to the suspected manager. The use of non-accusatory questions are to be asked initially in the interviews.

Before you begin this assignment you should re-read the chapters on interviewing and interrogating. You should also ensure you have watched the interrogation of Russell Williams.

Remember:

An interrogation is:

  • Accusatory: A deceptive suspect is not likely to offer admissions against his self-interest unless heis

convinced that the investigator is certain of his guilt. Therefore, an accusatory statement such as "Joe, there is absolutely no doubt that you were the person who started thefire."

  • Involves Active Persuasion:In an effort to persuade the suspect to tell the truth, the investigator will use tactics that make statements rather than askquestions.
  • To Learn the Truth:An interrogation should elicit the entire truth to the point of aconfession.
  • Conducted in a Controlled Environment:This environment needs to be private and free fromdistraction

Scenario:

A restaurant reported a break-in and theft of $5600 from a safe. The crime scene evidence suggested that the person responsible staged the burglary and had the combination to the safe. Two managers (Jim and Paul) were considered suspects because each of them had the combination to the safe. One manager (Paul) stood out as the most likely to be guilty because he resigned shortly after the theft. Consequently, he was the last manager interviewed. During the interview with the other manager (Jim), it was learned that the suspected manager was a regular user of marijuana, gambled and also that he hung around with an ex-employee of the restaurant who had a prior conviction for auto theft. During the suspected manager's interview, he denied any recent use of illegal drugs, gambling and a close relationship with the ex-employee. He became quite hostile in the initial interview process, denying anyinvolvement.
