Assume that Fred rented a kayak at Lake Tahoe. He signed a release of liability before he left with the kayak. Once out in the lake the weather changed and the waves got much bigger. The kayak was not designed for rough water and Fred was inexperienced. He capsized and drowned. His wife is now bringing a lawsuit for wrongful death. What are the issues?
