Assume that Les and Mary have been happily married for over fifty years in Cleveland, Ohio. Both are in their early eighties. Mary has come down with inoperable cancer of the stomach and is also suffering from dementia. Doctors can do little for her. She is in agonizing pain and in and out of lucidity. Her condition is tearing Les up emotionally and Mary has told him that she "wants to die." One day Les mixes up a lethal dose of tranquilizers, sedatives and alcohol. He has her drink it and she passes out. He then smothers her with a pillow. Finally, he calls the police. The police arrive and Les is charged with a crime. Technically speaking both today and at common law, what will that crime be? (Best answer please.) Reckless Homicide This is a Murder committed with Intent. Negligent Homicide No crime at all - The wife was suffering badly and gave her consent to be killed
