BACKGROUND FACTS
You recently completed your undergraduate studies and started a graduate position in the corporate services group at Legal Consulting Pty Ltd. Your manager learned that you studied LAWS11030 and assigned you to the 'Start-Up' team as a business law specialist to assist clients with the legal requirements of starting a new enterprise. Your first client is Enzo, a retired academic who has a passion for Italian food.
Enzo lives in Brisbane and is opening an Italian restaurant called 'Tastes of Naples' that will be operated by his new company called Tri Colour Enterprises Pty Ltd. Enzo hopes to build an Italian food empire in Brisbane and its suburbs and his first restaurant will specialise in serving food and desserts from the south of Italy and also sell various foods imported from Italy. While Enzo is very enthusiastic and knowledgeable about Italian food, he knows little about law as he was a literature academic and possesses little experience in business. In particular Enzo needs to understand how the Australian legal system and contract law will govern his new business venture.
Question - FINDING LAW
An important aspect of starting and operating a new business is finding relevant laws. Numerous online legal resources now exist. Entrepreneurs need to be able to locate laws and evaluate their effectiveness and reliability. Such a skill is especially important for Enzo to learn Australian law and determine the best sources of law.
In Part A of your report you must:
- Locate the websites for one State/Territory government regulator and one federal government regulator that has statutory responsibility for enforcing legislation in Australia.
- Identify one law in each online research source located in Part A.1 of your answer and then (1) identify whether the law is legislation (statute law), common law or equity (2) identify the relevant jurisdiction (3) describe the key features of the law.
- Evaluate the user experience from a business person's perspective for each website located in Part A.1. Your evaluation can include the format of the website, the use of visual aids, explanations of laws and legal processes and links to additional information or support.
