Barget Ltd is a large department store. They have a food court inside their shop. As part of the restrictions to deal with a global health pandemic, they have been advised by health officials to ensure adequate social distancing between their customers. They do by way of putting tape on the floor indicating the required distance apart that people must stand while ordering their food. Many parents bring their young children to the food court for meals and snacks. Some of these children like to get up to mischief. One day, a particularly naughty child rips off all the tape and the busy staff do not notice until late in the day. That same day, the store is visited by Anne. Anne believes the virus is a 'left-wing media hoax' and has not changed her lifestyle at all to ensure she does not contract the illness. Unfortunately, she does contract the virus and, although she recovers, she loses her job because she cannot go to work for six months. It is discovered she contracted the illness at the Barget food court.
Advise Anne on whether she can successfully sue Barget Ltd for negligence and recover all the compensation she seeks. She wants to claim all her medical expenses, her loss of income and a further amount to compensate for lost wages of her husband, who now refuses to leave the house.
