Bessie and Jessie are two elderly sisters who have lived together all of their lives. They inherited their house from their mother in 1975 as joint tenants and became registered proprietors. In 2016 Bessie started a relationship with a younger man, Brad, and Jessie disapproved of him, and thought he was a 'gold digger' just after their house when the sisters died.
On 7 February 2017 Jessie went to see a solicitor and asked what she should do to protect her share of the house. The solicitor advised that she should make a will, and then she could leave her share to whoever she liked. The solicitor helped Jesse draw up a will. In the will, Jesse left interest in the house to their long-serving gardener Eddie.Jessie went home and said to Bessie: "you can be foolish if you like but I've sorted it out so at least Brad won't get his hands on my half when we're gone." Jessie died the next day and the solicitor read the will to Bessie.
Bessie asks her carer Lily what she thinks as she is a law student. Lily thinks that Jessie's interest in the house belongs to Bessie now.
Eddie is contesting this and wants to sell the house. Eddie also says that in any event, he donated and installed a fountain in the garden with a bronze angel spouting water which was connected to the outside water system with pipes. He says that the fountain is his property whatever happens with the house.
Advise Bessie on whether Eddie is entitled to the house, and fountain.
