Bob and Angels big wedding day is approaching. Bob has been frantically renovating their unit so they can move in after the wedding. Angel convinces him to buy new wooden window blinds for the home. They go up the road to Krapston Blinds. When they enter the store they are greeted by a smiling shop assistant who gives them a product brochure. The brochure has the following text on the front cover:

All Krapston Blinds are manufactured and produced by Krapston Craftsmen locally, and guaranteed for the Aussie climate. Remember its Krapston with a Capital K! You can count on us!

Bob specifically tells the shop assistant he wants Krapston products because they are Australian made rather than cheap imports. He also tells the shop assistant that he has no experience in building or renovations and he is quite confused by all of the products on the market. The shop assistant says to Bob: All our blinds are manufactured locally at our workshop located in Kingscliff northern NSW as stated on our website. Our wooden blinds are water proof and will not peel or fade Guaranteed for life. Bob checks the website and notices the blinds are said to be Australian Made. On Angels insistence, Bob accepts a quotation handed to him for $20,000.00, and reluctantly signs the sales confirmation order annexed to the quote, noticing the following clauses after he signs it:

Eight (8) weeks later, Bob is still waiting for Krapston to advise of the installation date. He calls, and he is advised by the shop assistant that the overseas shipment from China containing the blinds is yet to arrive. When Bob puts down the phone he raises his concerns with Angel and says he thinks they have been tricked. Angel tells him not to worry, and assures him all will be ok. He decides not to raise the matter with Krapston. Finally, the blinds are installed 2 weeks later. That night, Angel decides to leave all the windows open as the heat is sweltering. It rains lightly overnight and the blinds get wet. Water pools around the perimeter of the blind frames. Angel and Bob do not notice until the next week, when they see the blind blades and frames have warped, cracked, and peeled. The blinds are completely ruined. The swollen frame has also exerted pressure on and damaged Bobs ornamental French provincial style window trims with $25,000 worth of damage. Angel cancels the wedding with Bob telling him that if he cant manage trades in his renovation, he must be a total loser. Bob is shattered and he spends $5,000.00 with the local florist trying to win her back in time for the wedding and $5,000.00 with Divorce Lawyers for legal advice. Bob is infuriated and when he demands a refund and compensation for losses being $35,000.00 Krapston deny any responsibility, drawing his attention to Clause 102 above.

Advise Bob whether he can bring an action against Krapston for breach of contract.
