According to police, Bobby entered the store and yelled, "Give me all your money!" Nick refused and tried to defend himself and was accidentally shot by Bobby during the fight. Bobby ran away and Nick later died, as a result of his injuries.

The police do not have any witnesses to the incident, besides a 90-year-old man who was out walking his dog and saw what happened from the other side of the street. He told police that he, "believed he recognised the offender to be Bobby".
