Objective:

oTo present an understanding of civil court proceedings in presenting the operation of court proceedings, reporting and presenting.

Administrative Process:

oThis is an individual project.

oFollow APA guidelines and proper legal citation.

oIndependently attend a Provincial or Supreme Court trial that relies on viva-voce evidence and does not concern family law:

oIndependently:no submissions of duplicate trials.

oTrial:includes a question of law and/or fact

(which differentiates it from a sentencing hearing)

oViva-voce:oral evidence provided by one of the parties and/or witnesses

(not a case in which lawyer presents submissions).

oFamily Law:please be respectful to litigants.

oCases in which students have or had a personal involvement are disallowed.

oHearing lists are available on-line, unfortunately the lists only present the cases scheduled for the following day:

Attend Supreme Court in Vancouver as case are potentially more interested and alternate cases more likely should a case not proceed as scheduled.

Look for "T" on the hearing lists (denotes trial) and a style of cause that suggests a civil suit (no "R" in style of cause).

Speak to court staff for guidance on cases in court on the day and for background on a particular case.

Review the project requirements in advance of court to ensure you have fulfilled the requirements.

Evaluation

oThis project contributes 15% to your term mark.

oFor verification purposes, the failure to provide the place of trial and courtroom number may result in a mark of zero.

oAs the purpose of this project is to assess your ability to research, analyze, and communicate, the presentation of work product that is not yours (even if properly cited), precludes assessment of your competency.

oYou are welcome to review a draft submission with your peers or professor prior to submission.

Deliverables:

Prepare a written report that includes:

oAn overview of the proceeding3 page maximum

oAn overview of question of fact and/or law in issue3 page maximum

oA minimum of two case briefs related to the issue2 page minimum

oAn analysis of potential impact on a business and 3 page maximum

potential response that would reduce the risk

oOverview of Proceedings - include:

oYour overall impression of the court proceedings

oThe approach to the presentation of evidence

(in relation to the question of law or fact)

oParts of the proceeding you considered effective and ineffective

oRecommendations for improvements of the process.

oOverview of question of fact and/or law in issue - include:

oSummary of the current state of the law that utilizes at least two case briefs that as precedents (utilize the ratio in your overview, include case briefs in appendices).

oCase briefs should follow the standard case brief format (see course notes).

oAnalysis of strengths, weaknesses, and state of development of the law in issue.

oHow the issue may present a risk to an organization.

oHow the likelihood or impact of the risk may be reduced or avoided.

oYour cover page should reference:

oStyle of Cause;

oPlace and date of Trial or Hearing; and,

oCourt, courtroom number, and name of the Judge.
