Tammy owns a company which manufactures confectionary. After tasting a sample of Kim's dark chocolate, Tammy enters into a contract with Kim pursuant to which Tammy agrees to purchase 1000 kilograms of high grade dark chocolate. Kim supplies chocolate to several other confectionary manufacturers. Kim sources his raw products from North Korea. Assume that it is illegal in Australia to import goods from North Korea or sell goods of North Korean origin. Prior to entering the contract, Kim tells Tammy that his chocolate is the best chocolate in Australia. He also tells Tammy that he has a large supply of dark chocolate on hand. In fact, most of Kim's chocolate is low grade milk chocolate, not high grade dark chocolate, and he has none of it in inventory. When Kim delivers the chocolate to Tammy, Tammy is disappointed. Instead of delivering dark chocolate, he delivers white chocolate. Tammy cannot use white chocolate in her manufacturing process. Further, she is unhappy with the quality of Kim's product.
