BUSINESS LAW

Blake went to Ken's grocery store to buy some hamburgers, hot dogs and soda for his annual BBQ. Blake picked out what he needed to buy, put it in his shopping cart and started walking to the cash register. An hour before Blake entered the store Ken had begun to fix a section of the floor that needed repair leaving a number of loose tiles that were sticking up slightly from the ground. While the tiles were easy to trip on, it was difficult for customers to see that the tiles were loose. Ken did not block off the area of the store with the loose tiles and he did not put up any warning signs. Blake tripped and fell on the tiles and broke his ankle. Ken called an ambulance to take Blake to the hospital. On the way to the hospital, a car Sophia was driving collided into the ambulance. Sophia was driving at a high speed and lost control of her car. Blake believes that Ken is responsible for the injuries he sustained when Sophia drove into the ambulance since the initial injury occurred at Ken's.

(a) In an action by Blake against Ken to recover damages for his broken ankle judgment for whom? Explain fully.
