Analysis:
"California Governor Newsom signed Assembly Bill 701(AB 701)which requires employers to share the "productivity quotas to workers and regulators." This can allow workers to sue employers to eliminate problematic targets. Assembly Bill 701 will take effect on January 2022. After AB 701 takes effect, employers will have 30 days to give workers their production quotas.
Governor Newsom's reasoning for signing the bill was to protect employees from experiencing serious injuries or facing harish punishments when quotas are not met. At times, employees can be overworked which causes them to suffer serious injuries in order for them to meet certain standards. Business groups who strongly opposed the bill stated that AB 701 can encourage an "explosion" of ligation issues from employees instead of encouraging good work ethic. However, various studies have shown that Amazon employees suffered injuries at a much faster rate than the rest of the warehousing industry.
Industry Analysts predict that the bill could affect Amazon's cost instead of their rapid delivery time. One solution could be to hire more employees. Amazon has stated that they have only fired 1% of employees for underperformance. They did not have any further comment on the passage of AB701.
In chapter three, steps to civil ligation also known as an "adversary system" were discussed. Although groups who opposed AB701 felt the passage of the bill would severely increase ligations disputes against Amazon for any wrongdoing, ligations have strict rules. It is most often heard from a neutral party such as a judge or a jury. Strong facts must be presented during the proceedings. Therefore, without concrete evidence ligations cannot be processed. The first step to solve the disagreement is through informal negotiations. If the issue isn't resolved the first step of the lawsuit is pleading the case with an attorney. The defendant must respond with an affirmative defense or with a motion to dismiss the case altogether. The entire trial process is a tedious journey. It can take from a few months to a few years to solve a ligation case. Moreover, it can also attract unwanted media attention.
Labor Unions are a powerhouse and are essential to the workforce. I once saw a bumper sticker on the back of someone's car that read "Thank your labor union for your weekend." Labor Unions really did in fact fight for the rights of employees. In the article, it was stated that two separate studies that were supported by labor unions showed that Amazon workers suffered severe injuries at a faster rate than the rest of the warehouse industry. Since the Pandemic started more and more people are staying home and ordering items online. It has increased the need for warehouse workers. However, the increased need should not encourage their employer to exploit them in order to meet the high demand. As the article also stated, the increase in demand can be solved by hiring more employees. Since unemployment has been stopped, people are in need of jobs or second jobs in order to pay bills. Taking a job at Amazon might not be a job someone went to college for, but sacrifices need to be made in order to survive in the current moment."
