On the same day, June 1, Marcus telephoned Jacqueline and asked, Can I have until July 1 to think over your offer? Jacqueline replied, Sure. You have an irrevocable offer that will not be withdrawn before July 1.
On June 7, Marcus wrote to Jacqueline, I am still very much interested in your offer. I am a bit short of cash at the moment and would like to know if you would consider taking $15,000 cash and my 30 day note for the other $10,000? [signed] Marcus. The letter was received by Jacqueline on June 9, but Jacqueline did not reply to Marcuss letter.
On June 20, without letting Marcus know, Jacqueline sold and delivered the Eames chair to Geraldine for $30,000 cash.
On June 22, Marcus, who still did not know about the sale to Geraldine, wrote to Jacqueline, I accept your offer of June 1 and will pay you $25,000 in cash when I pick up the chair. [signed] Marcus. Because of a delay in the mail, Jacqueline did not receive the letter until July 2.
Jacqueline wrote back: Sorry, I have already sold the chair to Geraldine and anyway, the offer expired on July 1 so your acceptance was too late. [signed] Jacqueline.
