QUESTION 1 Andrew is walking home on a Saturday night with his friends after spending an evening in a night club with them. He has drunk two bottles of wine when he was at the bar and due to that he is now totally intoxicated as he started to talk continuously to his friends and to himself. As his friends are leaving to their houses, Andrew is now walking alone and he passes by a 24- hour supermarket. He then walks into the supermarket and buy himself a MacBook, an Apple mobile phone, a leather jacket and three cartons of Perrier Drinks using his platinum credit card at a total cost of RM12,000. When he wakes up in the morning on the next day, he is so confused and surprised to see all the stuffs next to his bed and he wonders where they come from. Subsequently he looks at the receipt in the shopping bag and realized that all the stuffs were bought using his credit card when he was drunk. ADVISE Andrew if he could take all the purchases back to the supermarket and get his credit card transaction cancelled. (10 Marks) QUESTION 2 Alisha is a brilliant student. She has been performing so well in her primary school and secondary school as she got 6 A's in her UPSR and 9 A's in her PT3. She is now 16 years old and taking architecture subjects for her elective courses because she dreams of becoming a chartered architect in the future. One day, her mother, Puan Latifah told Alisha that her friend, Puan Sri Maya is looking for an apprentice for her architect firm in Kelana Jaya, known as Bina Jaya Architect Sdn Bhd. Puan Latifah also handed Alisha an official letter from Bina Jaya Architect Sdn Bhd offering her to be an apprentice in the company because Puan Sri Maya knows that Alisha has a very huge potential in becoming a professional architect in the future. After several days thinking about the offer, Alisha then enters into a contract that states that she shall be an apprentice of the firm. Later in the same week, Alisha receives a call from The Royal Institute of British Architect offering her a scholarship to do A Level in Architecture on a condition that she must do it in one of the universities in Scotland. Alisha is so excited to hear that because she always wishes to study in the United Kingdom. A week before she is due to start work in Bina Jaya Architect Sdn Bhd, she changes her mind and decides to accept the offer from The Royal Institute of British Architect. ADVISE Bina Jaya Architecture Sdn Bhd if it has a cause of action against Alisha. (10 Marks) SECTION D: SCENARIO BASED QUESTIONS (20 MARKS) There are TWO (2) questions in this section.
