Allie Johnson had just completed her second month of teaching at her new job. She was a single mother who had returned to school as a mature student. This job was her last chance in what had been a hard and unfair life. She had left home at fourteen years old and at first had couch surfed at friends houses but at 17 she had nowhere else to stay and so became homeless. On the streets she developed a drug habit and had been assaulted several times. One day she was talking to one of her friends from school who seemed to be doing quite well. When they talked she found out that her friend worked as a stripper in Northern B.C. and Alberta. Feeling she had no other choices Allie also began to strip. At the same time she realized that this was not a life she wanted and so she returned to school but continued stripping on weekends and during the summer holidays. Nine years later she graduated from college and held credentials that allowed her to teach high school Math. She had left the stripping profession 2 years earlier. Allie attended recruitment fairs and was hired as a part-time teacher by a private religion based high school. When she was hired she signed a contract which contained clause which stated The teacher agrees to conduct himself (herself) with due regard to public conventions and morals and agrees that he (she) will not do or commit anything tending to degrade him (her) in society or bring him (her) into public hatred, contempt, scorn or ill repute. The teacher also states that he/she has disclosed all events in his/her past that might breach this clause. The teacher acknowledges that breach of this clause will lead to termination without notice. Allie had difficulty with the school principal from the beginning of her teaching career. He felt she wasnt conservative enough, she dressed inappropriately and might be a bad influence on the students. Several weeks later Allie was in her classroom when Bill Jones, the parent of a student walked in with the principal. She recognized him immediately as he had attended several of her shows and had tried to follow her home. The principal told Allie that Bill Jones complained that she used to be a stripper as was a bad influence. The Principal stated he would be investigating the complaint as required of him under school policy. Subsequently Allie Johnsons first evaluation as a teacher was not satisfactory. She was found to need improvement. During the evaluation the Principal offered to meet with her after class to help her with her teaching. She refused. During the discussion between the principal and Allie, Allie stated that he was a church going prude. The Principal told her to improve or else. Allie stormed out of the meeting stating she would not change. The principal recommended that Allie be dismissed due to her teaching standards not meeting expectations and she was unwilling to accept advice to improve upon them. Allie had been evaluated by both the principal and another teacher and they agreed that her teaching was not to an acceptable standard. She was terminated and the school board refused to overrule Allies termination. In her discussion with her lawyer Allie pointed out the following: The morality clause had never been brought to her attention She did not get a copy of the contract She had never been asked about her conduct prior to starting teaching. Allie sued to get her job back.
