Calunod, John Paul transported fifty (50) bags of rice on the vessel M/V Enopia, Jay Mar owned by Kitane, Nichole John Philip from Dumaguete City bound to the port of Manila. When the said vessel arrived in Manila, it turned out that the bags of rice now becomes only twenty-five (25) or half of it were lost. Is it necessary and mandatory for Calunod, John Paul to prove that M/V Enopia, Jay Mar was negligent in transporting his fifty (50) bags of rice that caused the lost? Why?
