Can brief this case Gonzales v. Carhart like facts and why the court held it?
ontraception 334 (2006). Alberto R. Gonzales v. Leroy Carhart et al. United states Supreme court, 2007. 550 U.s. 124, 127 s.ct. 1610, 167 L.Ed.2d 480. JUSTICE KENNEDY delivered the opinion of the Court. [In Stenberg v. Carhart, 530 U.S. 914 (2000), the Court overturned a Nebraska partial-birth abortion law that banned intact D & E (often termed D & X) procedures. The Court found two constitutional problems: first, the law was vague as to what procedures it actually criminalized; second, there was no exception to protect the health of the mother. After Stenberg, Congress passed a national Partial-Birth Abortion Ban Act of 2003. The federal statute prohibits 'tmowingly perform[ingl a partial- that is [not] necessary to save the life of a mother." birth abortion . There is no exclusion for abortions needed to protect the mother's health
