Can I sue Samsung for data loss in one of my portable SSD that got corrupted? The drive failed under warranty after two years of adequate and careful usage; the warranty covers 3 years. But it walso says that they are not responsible for the loss of your data caused by the failure of their device. As a lawyer, I feel like as the main functionality of the driver is to store data, how can you not rely, i. e., warranty data loss? Especially if the loss occurs under the warranty time. Now, Samsung wants me to send the my drive and they say that in order to fix or replace it they will wipe my drive. The problem is that if they wipe it, then there it goes my evidence of their flaweless device.
How should a proced? Also, I got ym degree in Law in Brazil, not here in the US. So, idk ifor sure f here we have a case, but I know that in Brazil this would be a very ez action to win because the main purpose of the device is to store data, meaning that if you can't rely on it to do such task and that caused you lots of damage, then it's the company's responsibility to take care of you and pay for the damages they caused. So, please help me with this matter! Thanks!!
