SOALAN QUESTION 4 Hot Electric Sdn Berhad (HESD) is a company selling electrical goods. Mr. Problem wanted to buy a washing machine, and he signed a hire purchase agreement with HESD. TWO (2) weeks after the agreement was signed, Mr. Problem had not received a copy of the hire purchase agreement from HESD. When Mr. Problem asked for the hire purchase documents, HESD denied their obligation to prepare it for Mr. Problem within two (2) weeks. Five (5) months later, Mr Problem retired, and he received his EPF money which amounted to RM100,000. Mr Problem decided to use the money to settle all his debts including the balance for the instalment of the washing machine. When Mr. Problem went to HESD, they refused to accept the payment since early settlement by customers would cause a disadvantage to HESD. Mr Problem was not satisfied with HESD's refusal and wanted to take legal action against HESD. Mr Problem was diagnosed with kidney problem, which needs him to do daily dialysis. The hemodialysis center was about 10km from his house, and Mr Problem found it inconvenient to travel every day. He then bought the dialysis machine by installment from Brilliant Pharmacy (BP) for RM50, 000. After using it for three (3) months, Mr Problem was not able to pay the monthly installment. When demanded by BP, Mr Problem said that he does not have to pay since the hire purchase agreement signed by them was not valid as the dialysis machine was not covered under the First Schedule to the Hire Purchase Act 1967. In the meantime, Madam Problem, Mr. Problem's wife, bought a car financed by Smart Finance Bhd (SFB). The vehicle cost about RM90, 000, and the installment was RM800 per month for nine (9) years. After using the car for eight (8) years, Madam Problem was unable to settle the monthly installment. She defaulted to pay the installments for September and October. SFB served a notice of repossession on the 1 December 2019. After receiving the notice from SFB, Madam Problem wanted to settle the outstanding balance for September and October installments. She borrowed some money from her friend and intended to make a payment to SFB on 15th December 2019. Unfortunately, on 14th December 2019, SFB repossessed her car. Madam Problem was very disappointed with SFB's action and claimed that SFB did not follow the right procedure of repossession. Nasihat Encik and Puan Good berdasarkan peruntukan Akta Sewa Beli 1967.
