Juliette Diana Greco is an attractive woman in her late 30s who works in information technology. She is always very well dressed. She does not wear a wedding ring. She lives at 126 George Court, Brampton, Ontario L1X 2V4 TEL: 219 791 2234. Three years ago, on or about April 1, 20-, Juliette loaned $7,500 to her cousin, James Barry Hardwick, who lives at 1128 Ramsgate Close, Brampton, Ontario L3X 6Y8 TEL: 219 791 3687. James has always been Juliette's favourite cousin. Once or twice every summer, Juliette used to invite James, his wife Pamela, and their two boys to her house for a barbecue. She sent the boys presents on their birthdays and at Christmas. At the time she lent him the money, Juliette knew from conversations with Pamela that James was having financial problems. Pamela still made a good salary, but the family was struggling. Juliette herself had had a good year financially, so when James asked her for a loan of $7,500, she agreed to advance the money, but took the precaution of having him sign a promissory note, dated April 1, 20-. Under the terms of the note, the entire amount owing plus interest thereon at 2.90 per cent per year commencing on April 1, 20- compounded annually was to be paid in full on or before April 1, 20+3. Pamela co-signed on the note. Over the years since the loan was made, Juliette has phoned and emailed James several times to discuss payment. James has made several promises to pay over the phone, but has paid nothing. The due date for full payment of the amount owing plus interest has now passed. James no longer answers Juliette's phone calls. If Pamela answers, she is extremely rude to Juliette. The last time Juliette called, Pamela answered the phone. Before Juliette could say anything, Pamela shouted "You've got more money than you'll ever spend in your whole life! Why can't you leave us alone!" Ms. Greco decides to commence an action in the Small Claims Court for the money owing. She retains Prior Mustafa LLP to represent her in the matter. The file is assigned to you. She provides you with the following documents: By their signatures hereto, the undersigned JAMES BARRY HARDWICK and PAMELA LAURA HARDWICK acknowledge receipt of the sum of SEVEN THOUSAND FIVE HUNDRED DOLLARS ($7,500.00), advanced by Juliette Diana Greco to James Barry Hardwick and Pamela Laura Hardwick on this day. The entire principal amount, plus interest thereon at a rate of 2.90 per cent per annum, shall be due and payable in full on or before April 1, 20+3. In the event of default by James Barry Hardwick and Pamela Laura Hardwick, interest shall continue to accrue at a rate of 2.90 per cent per annum until such time as all amounts owing are paid in full or judgment is obtained, and post-judgment interest shall accrue on the judgment amount at a rate of 2.90 per cent per annum until such time as the full amount of the judgment plus post- judgment interest and costs are paid in full.
