PRACTICE ESSAY #7 Archie, a reputed freeloader, was in love with Veronica Lodge, the wealthiest girl in town. One afternoon while at Veronica's home, Archie spotted Mr. Lodge's expensive Meerschaum pipe on a coffee table in the "sitting room." With some of the remaining tobacco he had taken from Mr. Lodge's private supply some weeks earlier, Archie filled the pipe and began to blow smoke rings into the air. When Veronica called him to come to her room, however, he immediately placed the pipe on the table, intending to "borrow" it later for their date. (He thought the pipe gave him an air of sophistication.) Veronica proudly handed Archie one of her father's golfing caps and stated, "Take it. My father will never miss it." Archie immediately placed the cap on his head. (Unknown to Veronica, just that morning Mr. Lodge had told his wife that he had too many hats and could not wait to get rid of some of them. Suddenly, the smoke alarm sounded, and a thick smoke filled the room. Archie screamed "Fire!" and grabbed an antique chair from Veronica's room, smashed out her window, and carried her to safety. Believing that the pipe was the cause of the fire and observing the condition of the chair, Archie ran from the house in fear. Unknown to him, the pipe and many of the furnishings in the sitting room had been severely damaged by the fire. Mr. Lodge was not certain who started the fire, but he swore it was Archie and vowed to make him pay. Knowing that Archie would return to see Veronica, Mr. Lodge placed a spray gun at the entrance of his estate in a strategic position so that a trip wire would trigger the apparatus. It was customary in this area to employ such a device. As expected, Archie triggers the device, which triggers a substance that hits Archie in the face with such force that it knocks him to the ground. Mr. Lodge runs in Archie's direction with a 12 gauge shotgun, believing a forest animal had triggered the device. Archie, afraid of what might occur, struck Mr. Lodge with the flashlight. When he discovered he had actually struck Mr. Lodge, Archie runs through the land of Mr. Greenjeans, Lodge's next door neighbor, trampling his rare and expensive flowers as he left. Lodge ranted, "Archie, I know that was you. I'll kill you, you stupid freeloader!" Archie still decides that he must see Veronica. When he looks into the mirror, he sees that his face is broken out into a rash too horrible to describe, but believes Veronica's love for him will overcome it. When he gets to Veronica's home, there is a garden party in progress. Mr. Lodge greets him and yells for all the guests to hear, "Where do you think you're going, you pimply faced baboon? Why don't you do us all a favor and soak your ugly face in some salt water?" Everyone laughed and applauded Lodge's verbal insults. (Lodge was fully aware that Archie was extremely sensitive about his skin and that the substance in the gun probably caused the damage to his face.) Archie slinked away, dejected, with tears rolling down his face, and was unable to sleep for several days. He also has lost his appetite. Archie decided that he had to get away for a while. As he was leaving town, driving the speed limit, a roughneck named Jughead drove behind him at a high rate of speed, blowing his horn and waving a hammer, yelling "Get out of the way, Zithead! You're going to pay." Archie was afraid. Jughead pulled over to the side of the road to pull himself together. Jughead again returned and blocked Archie's car with his car and stated, "The next time I tell you to move, you better do it, or I'll beat you to a bloody pulp. " He drove off. Archie arrived at a hotel to rest. Jughead sneaked in behind him. He temporarily locked Archie in the bathroom while he showered in order to place a dead snake in his bed. Unfortunately, Jughead fell and knocked himself unconscious. Archie saw him lying on the floor of his hotel room, dragged him into his closet, closed the door, and ran screaming from the room. Archie has come to you for help. Advise him of all the rights and liabilities of all the parties
