And here is my response:The 8th Amendment provision pertaining to cruel and unusual punishment to the excessive bail and excessive fines. For example, unsafe prison conditions where prisoners stay in a prison with poor living conditions during their criminal time. The cruel and unusual punishment provision of the 8th Amendment meant to protect criminals and people from excessive bails and fines from their violation. The Cruel and Unusual Punishments Clause is a clause where the Constitution limits the states on how they convict criminal offenders. The founding fathers include such a provision in the Bill of Rights, by fearing that the federal government would abuse the power to create federal crimes and punishments throughout the United States. Hope v. Pelzer is a case that violated the 8th amendment by a prisoner being handcuffed to a hitching post for 7 hours and was not able to take bathroom breaks. "In 1996, Larry Hope, an Alabama prison inmate, was handcuffed to the restraining bar known as a "hitching post" in Alabama's prison system" (Chin, 2003, p.913). Not only was Hope left shirtless in the sun for seven hours, but guards denied him water and toilet break throughout the day." Hope suffered pain in his wrists and arms, muscle aches, dehydration and sun" (Chin, 2003, p.913). The Eighth Amendment of the Constitution says there should be no excessive bails and fines prior to punishments.
