Carl Socco, a lawyer, loaned James Whitman, his partner, certain securities which Whitman, without Socco's knowledge or consent, sold, applying the proceeds to his own use. Socco caused Whitman's arrest in the presence of his wife, Mrs. Whitman, but had Whitman released on Mrs. Whitman's promise to deliver him, Whitmanm to Socco's office the next morning. The next morning, Mrs Whitman, her mother, Mrs. Wak, and Whitman appeared in Socco's office. Mrs Whitman was in very poor health, and both she and Mrs. Wak were mentally excited and unstrung. Socco told Mrs Whitman and Mrs Wak that Whitman had committed a state prison offense, for which he, Socco, could send Whitman to prison, and would do so unless Mrs. Wak indorsed a note in favor of Socco, whereupon Mrs Wak endorsed the note. Socco sued Mrs Wak on the note. Can Socco recover?
