Case 1:

Mrs. Collins (1991) Mrs. Collins was divorced from a famous rock star and living in Vancouver with the 2 children. As part of the divorce, she received a substantial payment along with a support payment for each child. She persuaded Mr. Collins to purchase a large house in West Vancouver, which he did, but he arranged that the house be held in trust for the 2 minor children until they reach 25 years old. Mrs. Collins became concerned about her financial position and persuaded the 2 children to transfer the title of the house to her. At the time of the trial, the oldest child who had reached the age of majority confirmed the sale, but the youngest child was still underage. Evidence was presented during the trial that this contract was for the benefit of the children, giving the children the security they needed, until they reached the age of 25 years. Evidence indicated that the minor child had received independent legal advice, and a psychiatrist testified that it was truly the desire of the child to make sure the mother had financial security.
