Case #1 On December 10, 2014, Sam Arthurs, aged 75 years, visited Bart Knowles, aged 80 years, and although he had tried unsuccessfully previously to get Bart to sell his farm, got him on this occasion to sell his farm. Sam gave Bart a cheque for $1,000 as a deposit. The following note was given to Sam: "December 10, 2014, Received from Sam Arthurs $1,000 as deposit on sale of farm for $100,000." The note was signed by Bart. Shortly thereafter, Bart consulted a lawyer and had a survey of the property done. After getting the survey, Bart refused to go ahead with the sale and argued that the agreement with Sam was not enforceable because of Bart's age and the Statute of Frauds.
