She earns minimum wage and this summer, regularly worked 28 hours a week for 14 weeks Dale worked full-time for his employer for almost 2 years and decided to resign in hopes of travelling abroad for a year. Shirley also worked an additional 50 hours in overtime throughout the summer to 'cover' for other employees shifts, which she 'banked' for time- off, but has not yet been compensated for. Dale's vacation entitlement was accrued during his tenure and was based on two weeks, during his first two years of employment and was increased to three weeks on September 19 2018 (during his final year). Finally, he had taken only two weeks of vacation, during the summer of 2018. In addition, Shirley had not taken nor been paid for any vacation time, which she is entitled to under the minimum of the ESA (under 5 years).
