Calvin Rhodes began his employment with Dresser Industries in 1955 as an oil industry salesman. Many years later, he took a job selling oil field equipment at another Dresser company that became Guiberson Oil Tools. After seven months at Guiberson, he was discharged and told that the reason was company-wide layoffs and reduction in force but that he would be eligible for rehiring. At this time, Rhodes was 56 years old.
Within two months of Rhodes's discharge, Guiberson pil Tools hired a 42-year-old salesperson to do the same job. Rhodes then learned that his boss at Guiberson had said, right before he was discharged, that Guiberson could hire two young salesman for what some of the older salesmen were costing.
Rhodes then sued Guiberson for violating the ADEA.
