Chris Ballard and Cathy Melchik hired Sheldon Dillon to represent them when sued by the Concord Hotel Company. Dillon agreed to be paid $200 an hour less than his normal fee, provided that he would have a lien against any attorny fee wards. In March, the court entered judgment against Concord. Concord appealed. The court then amended the judgement to award Ballard and Melchik $289000 in attorney's fees, and Concord did not appeal this. Ballard, Melchik, and Concord negotiated about a settlement, and Dillon advised them of his right to the attorney's fee ward. Ballard and Melchik signed a settlement agreement by which Concord agreed to dismiss its appeal, and the plaintiffs agreed to abandon the fee award. The parties did not inform Dillon. He sued Concord for intentional interfering with the performance of a contract. Should he recover?
