Click to Launch In this module, you learned that in order for a contract to be valid, you need to have adequate consideration and capacity. In this discussion, you will have an opportunity to discuss whether adequate consideration and capacity exists or not. Read this Mental Capacity Case regarding a sister who argues that her sister did not have mental capacity to sell the family home. You will address whether there was adequate consideration and capacity in the questions below. Initial Post In your initial post, address the following: . Do you believe Susan had capacity to contract? . Do you agree with the Court's ruling in this case? Would you uphold the contract? Be sure to explain your answer based on the legal principles we have been discussing in this module. Note: You will not be able to View or respond to any of your classmates' posts until AFTER you have posted your initial response. Peer Response In addition to your own response, you MUST read and comment on AT LEAST ONE of your fellow classmate's posts. As part of your reply, state whether you agree or disagree with the decision made by your classmate about whether or not the store owner could bring a civil suit against the defendants. Make sure to tie your answer to what you have learned in this module. I expect that your comments will be polite and respectful of others opinions.
